Tony Magrathea

The Man
Tony Magrathea is a dual national British and Australian citizen.
He was born in 1957 and came to Australia in the 1960s as the son of ten pound poms.
He is currently trying to overthrow the Australian government by using only a keyboard. He is leading the campaign to discredit Tony Abbott the current Prime Minister of Australia. According to Mr Magrathea Mr Abbott is in the job illegally. This page is entirely about Mr Magrathea's campaign. Tony Magrathea is middle aged and arthritic, a gardener and lover of the good life. That’s the Felicity Kendal sort of good life, not the life lived by the billionaires in this country. Chronic arthritis makes his gardening efforts a bit slower than they should be.
He came to Australia from England with his parents in the 1960s and went to the same school as rugby league great Ray Brown and TV reporter/commentator Stan Grant. Later sports life had him playing rugby with David Campese until the broken back problem.
After that, it was 25 years in the public service working with Defence, Taxation and the Bureau of Statistics, followed by love at first sight and settling down with the woman in his life in the noughties.
He writes for fun and calls himself “the ideas man”. Some would say his ideas stink but that could just be flatulence. His Twitter account is mainly for fun and politics and is @dickybeacholdie. IN a good week up to 600,000 tweet, retweet and retweet again about his hobby of overthrowing the government with a keyboard.
He started studying again in his 40s so that he could play word games with town planners and local councils, and have the cheek to actually know what he was talking about. He took up studying for the Bachelor of Urban and Regional Planning as much for the knowledge the course offered as for the BURP after his name.
The Hobby
Tony Abbott, the Prime Minister of Australia was born in England to a British father on the 4th of November 1957. He was born at the Lying in Hospital, Lambeth Road, London. A copy of the paperwork is in the newspaper article. British citizenship legislation at that time sets out that a person born in Britain to a British parent is a British citizen.
To be Prime Minister of Australia, in fact to be a member of federal parliament, a person must ensure they only have Australian citizenship, it is specified in the Australian constitution S44 that members of parliament ensure they are not under any acknowledgement of allegiance, obedience, or adherence to a foreign power, or is a subject or a citizen or entitled to the rights or privileges of a subject or citizen of a foreign power.
In October 2015 the Department of Prime Minister and Cabinet answered an FOI request to see his renunciation of British citizen paperwork, the response to the FOI request was that the paperwork did not exist. The original request was a negative for the FOI system so did not show up as an official piece of paperwork on the departmental FOI logs.
Tony Magrathea has asked for an FOI copy of that 2014 FOI so that it will always be listed on the Department of Prime Minister and Cabinet's FOI log The paperwork from Tony Magrateha's FOI request to the department is and the FOI released is here. Once the department updates the FOI log a direct link to the form on the departmental computer will be posted here.
Requests to the British Home Office have returned a response which is set down the British FOI legislation, they can neither confirm nor deny the document exists. The FOI legislation can not release information of a personal nature, and releasing details that they do not have that information apparently brings in the neither confirm nor deny response.
Some in Mr Abbott's political party and the right wing main stream media consider this sort of research is " birther", but as Tony Magrathea pointed out the birther craze was from the racist side of the Republican Tea Party in the USA which could not come to terms with President Obama actually being born in the USA. The story has been carried by Pravda, Channel 9 in Australia, Sky News on Deryn Hinch's new television show, Sydney Morning Herald, the Daily Mail in the UK, the AIMN, and quite a few stories by Ross Jones of Independent Australia.
A petition of more than 27,000 signatures was started before the October 2014 FOI and presented to the leader of the opposition Bill Shorten, Tanya Plibersek and Adam Bandt asking them to question Mr Abbott about his British citizenship.
The court case
On the 26th of March 2015 Mr Magrathea sent a letter to Mr Abbott advising he considered Mr Abbott was in breach of contract. On 18 September 2013 Mr Abbott swore an oath of office to well and truly serve the people of Australia. This is a verbal contract between Mr Abbott and Mr Magrathea, as he is one of the people of Australia.
Mr Magrathea considers Mr Abbott is in breach of that contract because to the problems with Mr Abbott's renunciation of British citizenship and the relevant papers papers not existing. Mr Magrathea is seeking relief of $200 per day as set down in the Australian Constitution S46.
The blog
Mr Magrathea's original blog on the hobby of overthrowing the government was closed by a denial of service attack. this happened in August 2014 shortly before his gmail account was hacked and everything in that deleted. The new blog has a lot more detail than is available in just this small wiki entry and also has some of his other writings and ideas.
